Talk Talk says ISPs can rely on EU laws to avoid broadband disconnection

Broadband giant Talk Talk has stated in a recent report that Internet Service Providers will not have to cut illegal file sharers off right away thanks to EU regulations.

Many Internet Service Providers have been angered by plans to cut off illegal file sharers if they are found to be engaging in this activity, and the matter has caused a lot of controversy recently with the entertainment industry claiming that it is losing huge sums of money as a result of illegal file sharing.

However, one broadband giant that has been fighting against the disconnection of illegal file sharers, Talk Talk, has announced recently that it is backing an EU law that will mean that Internet Service Providers do not have to cut off illegal file sharers right away. The regulations could cause problems for the government’s plans to tackle illegal file sharing through disconnection.

Talk Talk is backing the law as part of its Don’t Disconnect Us campaign, and has sought legal advice over the regulations. The company has concluded that in order for someone found to be illegally file sharing to be disconnected a court order would be required, which means that immediate disconnection would not be possible.

The provider has openly criticised the government’s plans to tackle illegal file sharing, and one official from the firm said: “Although the new rules are not yet UK law, we call on the government to respect the spirit of what is intended and to drop its draconian plans to disconnect users without a proper judicial process.” The company has accused the government of breaching human rights in the past, having said: “The process outlined by Lord Mandelson substitutes proper judicial process for a kangaroo court. It is wrong and we also believe it is a breach of human rights.”
